CPJ PAYMENT OPTIONS:

You can make payment in full at any time up to May 1, 2025 via the payment portal which will be provided to you if you're accepted for the 2025 CPJ season. If needs be, you can also break up your payments into TWO equal payments totaling $1,250 each. The payments are due by May 1, 2025; and May 15, 2025, respectively:

Vendors with an average menu item price of $6.00 or less will qualify for a PROMO CODE that will bring their fees to $200 per Event Day and $2,000 for the full season. The menu you submit with your application will dictate whether you qualify for this discount. A PROMO CODE will be emailed to you with your Acceptance Letter that can be applied when making a payment.

Concert Operating Hours: Unless directed otherwise, all concerts begin at 6:00PM and end at 8:00PM. All vendors must be ready to serve concert attendees no later than 5:00PM. No vendor is to breakdown their stand before 8:00PM. If a vendor sells-out early, a sold-out sign must be displayed on stand until closing time. No vehicles are allowed to move through the designated Pavilion area during Operating Hours (6:00PM-8:00PM) for safety reasons.

Park Entrance/Exit Locations and Times: Unless directed otherwise, all vendors shall enter City Park at the City Park gate located on East 17th Avenue and Steele Street every Sunday during the 2024 concert season. Trucks must line up in the left turn lane on Steele and 17th facing east. If you are waiting anywhere else, you will be asked to move to that turn lane. The gate will be opened by a CPJ representative at 3:30PM every Sunday during the concert season. Because CPJ must close and lock the gates, all vendors MUST arrive by 3:50PM. Any vendor who arrives later than 3:50PM may not be permitted to enter City Park. CPJ representatives will be present to direct all vendors to the designated vendor area. Unless directed otherwise, all vendors will exit City Park to the North of the Pavilion by 8:45PM. CPJ representatives will be available to direct vendors out of City Park. At 9PM, this gate will be locked!

Weather and COVID-19: Concerts may be canceled, delayed, or rescheduled by CPJ in its sole and absolute discretion, when weather or other conditions, including changes in COVID-19 safety protocols or City and/or State regulations may present risks to its patrons, the bands, or others. CPJ will exercise good faith efforts to advise vendors as soon as practicable of the occurrence of a delay, cancellation, or rescheduling of a concert, but shall in no event be liable for any damages as a result of such occurrence. There are no refunds for bad weather or for any other reason.

Social Media: You agree to promote the City Park Jazz series and your presence there each week on your website and/or social media network(s) and you allow CPJ to do the same.

Spaces for food truck vendors are assigned on a first come, first serve, basis on the day of each concert, every Sunday during the 2025 concert season. No vendor can extend in any direction beyond their allotted space size and must keep the aisles free from displays for customer traffic flow to not impact neighboring stands. The CPJ representative shall have the right to assign space, and to change any such assignment at our sole discretion.

Vendors are required to anchor tent poles to ground with 40 lb. minimum weights per pole. In case of sudden wind, a vendor will be required to take down tent.

Access to electricity is not available. Quiet generators are allowed but must not exceed 70 decibels and CANNOT be placed on grass.

Spaces must be maintained in a clean and sanitary condition. Each vendor must maintain a trash can for their customers and pick up/sweep up all debris throughout their stay and at the end of the concert night ensuring a clean space that is restored to its original condition prior to leaving the park. Vendor must remove any and ALL waste that has accumulated in and around their space. CPJ garbage cans are for use by event customers, not for use by vendors. Please note that Denver Parks and Recreation are VERY sensitive about clean-up. Any vendor that leaks or spills any substance onto any surface in City Park and does not clean up that substance will violate this agreement and will not be allowed to attend any future CPJ concerts without warning. Additionally, Denver Parks and Recreation is also VERY sensitive about maintaining the grass and landscaped areas. Truck vendors must not drive on or park on grass or landscaped areas, even for the purpose of maneuvering into a space. If City Park Jazz or its organizers are fined due to a vendor not cleaning their space, the vendor will be financially liable for that fine. No refunds will be issued to any vendor who violates this agreement by failing to clean any spillage or leak.

Vendors and their employees will maintain an attractive, professional stand presentation and may be required to update elements of their stand. Interactions with customers, other vendors and CPJ staff will be professional and will keep with the community spirit of the event. Shouting at concert attendees for any reasons, including to solicit their business, is strictly prohibited. Smoking during operating hours in close proximity to the vendors area is strictly prohibited. For health reasons, keep any food products at least 6" off the ground. Tents, mobile units, signage, banners, samples, and all promotional materials are subject to CPJ approval.

Vendors must obtain any required permits necessary to operate during the 2025 concert season, including all sales tax/use permits, and will include copies of those permits with this application. Vendors are solely responsible for meeting all City and State COVID-19 protocols, including masks as required for food vendors. Check the requirements for your product. Vendors are required, at their sole expense, to carry commercial general liability insurance with the minimum coverage of one million dollars ($1,000,000.00) per occurrence. Current certificate of insurance must be included with application with City Park Jazz, its directors, managers, sponsors, agents, and employees listed as additional insured. Vendors' failure to continue insurance coverage shall not relieve vendor of its obligation to defend and indemnify CPJ against any claim or loss that would have been covered by such insurance.

Vendor is solely responsible for the classification of and payment to any of its employees or independent contractors and assumes all responsibility. To the extent Vendor has employees, Vendor shall obtain and maintain Worker’s Compensation Insurance in such amount as may be required by State law. Such policy shall include a ‘Waiver of Subrogation’ endorsement and Vendor may be required to provide a copy of such policy to City Park Jazz upon request.

All vendors are strictly prohibited from providing any glass materials to any concert attendee. By way of example, this prohibition includes, but is not limited to, glass plates, bowls, cups, and bottles.

If any fine, charge, or penalty is levied against CPJ for any vendor’s failure to abide by any term in this Section (II), or any requirement imposed by the City of Denver or the State of Colorado, or any other regulatory body, on vendor to operate during the 2025 concert season, vendor will indemnify CPJ for such fine or penalty.

Vendor agrees to provide a minimum of 3 (three) free meals for Volunteers for EACH show during the 2025 season. If vendor is willing provide any additional free meals each week for the entire season, please add the number of additional free meals in the same field as your initials below.

All payments to CPJ are NON-REFUNDABLE. CPJ will not refund your fee for any reason, including if you cannot attend a concert or if there is any delay or cancellation of any concert due to inclement weather.

If you are unable to participate in any concert DUE TO AN EMERGENCY, you MUST notify Vendor Management at least 72 Hours prior to the concert by emailing foodtrucks@cityparkjazz.org. If you have a planned absence, you must notify Vendor Management at least ONE week before the applicable concert. If you violate these terms more than once, CPJ reserves the right to terminate this agreement. CPJ will issue no refunds for all paid vendor fees if you violate these terms.

During the term of this Agreement, the relationship between City Park Jazz and Vendor is that of vendor and vendee. Neither Vendor nor its agents or employees shall under any circumstances be deemed agents or representatives of City Park Jazz, and nothing contained in this Agreement shall be construed in any manner whatsoever as creating a partnership, employment relationship, or agency between City Park Jazz and Vendor. Neither party shall have any right to enter into any contract or other commitment in the name of the other party or to otherwise bind the other party.

Thank you for your interest in being a Vendor for City Park Jazz’s (“CPJ”) 2025 concert season. The 2025 lineup of concerts is sure to draw record numbers this summer and your involvement will make it all the more spectacular. We look forward to seeing you this season!

Our commitment to maintaining quality and consistency for the thousands of community members who enjoy the series all summer limits the number of slots available for Vendors.

CPJ will host 10 concerts in 2025. The 2025 concert season will begin June 1, 2025, and a concert will occur every Sunday thereafter, ending on August 3, 2025. CPJ will only select vendors who will commit to participating in all 10 concerts during the 2025 concert season.; therefore, as a CPJ Food Truck Vendor, you must commit to participating in all 10 concerts.

Application Process:

Step 1: Submit your application by March 29, 2025. Be sure to fill it out entirely and read and initial each section.

Step 2: Food Truck Acceptance Emails will go out by April 15, 2025. The letter will include the link for submitting your payment. Reminder: not all food trucks will be accepted; therefore, please wait until you receive your letter before moving on
to Step 3.

NEW – Step 3. YOU MUST REPLY TO THE FOOD TRUCK ACCEPTANCE EMAIL YOU RECEIVE AND ACKNOWLEDGE YOU ARE COMMITTING TO PARTICIPATE IN THE 2025 SEASON BY APRIL 22, 2025 OR WE WILL OFFER YOUR SLOT TO ANOTHER APPLICANT.

Step 4: If accepted, you will have until May 1, 2025 to make payment with your selected CPJ Payment Option. You will also be required to send Vendor Management the following documents to secure your spot at the 2025 City Park Jazz Concert Series:

Copy of current Commercial General Liability Insurance to cover stand and product.
Copy of current City of Denver and State sales/use permits.
Copy of current Retail Food License or certification from the Denver Health Department.

Failure to make payment with your selected CPJ Payment Option and the delivery of the above documents by May 8, 2025 may forfeit your application, and space will go to another applicant. There will be no exceptions to these terms and conditions.
